Uneven Road Surface

An uneven road surface is a major potential hazard. Pedestrians and cyclists suffer the very real possibility of running over the surface and then suffering from a slip and trip accident. If it can be proven that the uneven road surface caused such a potential hazard that led to the slip or trip then it may be possible for the sufferer to make a claim for compensation against the local authority or whoever else is responsible for the maintenance of the roads and pavements.

Injuries caused by an uneven road surface can vary. Fortunately, the majority of incidents lead to fairly minor injuries including cuts and bruises. However, in some cases, it can prove worse. Sprains, fractures, breaks, lacerations, and serious head injuries are just some of the potential personal injuries suffered in cases of uneven road surface. The severity of the injury and the level of hazard caused by the road surface will determine how much compensation is awarded.

Slip and trip accidents on uneven road surfaces should be reported as soon as possible. This may mean contacting the local council. If possible, ask to complete an accident book. Keep notes of the incident yourself and get a photo or photos of the uneven road surface that caused the accident. If there are any witnesses to the accident, for example other passers by, then you should also try and get their names and addresses because this will help make your case.

It is usually the council’s or local authority’s responsibility to ensure that pavements and roads are kept in a reasonable state of repair. However, this isn’t always the case and when roads are left uncared for, accidents can happen. An uneven road surface can lead to a slip and trip accident and if you suffer injury and negligence can be proven then you have a very strong case to claim compensation for your suffering.
