NHS Care Negligence
Most healthcare provided by the NHS in the UK is of a very high standard but, unfortunately, cases of NHS care negligence can occur and when they do it tends to leave the patient feeling like they have nowhere to turn. The truth, though, is that as long as you follow certain procedures then there is a clear and relatively simple line to follow starting with the official NHS complaints procedure and, if necessary, going to court in order to claim compensation for NHS care negligence.
Most medical care carries some form of risk. If we are prescribed medication then there is a chance that we may have an allergic reaction and be taken ill. If we are given general anaesthetic for a procedure and have a reaction to this then it is unlikely that there is a case for NHS care negligence. Doctors and other healthcare professionals will explain the potential risks associated with any treatment or course of treatment that you are provided.
However, in cases where it is possible for the patient to prove that they were not given the appropriate level of care or the risks were not explained properly or thoroughly it may be possible to sue for NHS care negligence. For example, if you are misdiagnosed and this leads to complications that could have been avoided then you may have a case and you may be able to claim compensation.
Ideally you should start the process by talking to your caregiver. They may be able to explain in more detail your problem or provide a perfectly valid explanation. If this does not prove satisfactory then you can take your complaint further either with the practice manager or with the Complaints Manager of your GP or hospital respectively. As well as this you may also have a right to claim compensation.
Cases of NHS care negligence can lead to serious problems and major, detrimental effects on peoples’ lives. You place your trust in the NHS and expect to receive proper care in exchange.
